Poll on Amendment held in Latao
Easier Adoption of the Constitution now possible ?

[OCC: I’m really to lazy to play & write with two nations. So just consider both countries as one, in here named Latao – rules and names of political servers apply to both ;-))

[Lucriaria, 29. November 2005] People and Districts of the Confederacy of Latao have voted for a constitutional amendment that allows more room for future changes in the nation’s fundamental law.

The amendment changed the “Stability-Article” in Latao’s constitution, which denies to “limit or to void” the constitution.

Although Latao grants direct democracy to its citizens since it was founded, Latao’s society supports quite conservative policies regarding state law.

The amendment does not change anything how the constitution may be revised, since it will not allow different use of the existing Stability article before 10 years.

Stability a sacrosanct wealth
As mentioned before, Latao knows direct democracy even on constitutional level. The barriers are however set high for constitutional revisions and the people use them rarely.

Said “Stability-Article” (Art. 19) now consists of three paragraphs (substitutes). The first paragraph states, that no more than five articles or paragraphs may be changed by one (constitutional) initiative. The second paragraphs says that the constitution maybe not changed in a way that limits it as a whole or even puts it out of enforcement – not even temporary. The third paragraph was added by yesterday’s amendment and states that this situation shall be confirmed for each 10 years by the parliament.

Conservative Seal of Freedom and Independence
The “Stability Article” was bought in my fiercely patriotic right-wing conservatives that want to ensure the government can not transfer national power to foreign institutions such as the UN or other local (supra-national) organizations. The article also makes joining and utilizing international agreements and contracts very difficult as said people think, this is a transfer of national rights which is a clear threat to their national freedom and independence.

Futures Revisions require hard battles
The amendment passed the poll with a narrow and thin majority. 66.9 % of the required 66.0 % and 9 of the 15 districts (9 required for “double-majority”) voted yes on the poll.

It was only possible to meet the high requirements to change the constitution because this is quite a moderate amendment, a more extreme proposal might have been failed the poll by the people.

This fact requires the supporters of the amendment to prepare for other hard battles in the parliament and publicity to make Latao join the European Convention for the Protection of Human Rights and Fundamental Freedoms – although speakers of that movement say that yesterday’s amendment has nothing to do with their goal.

There are numerous other amendments of several kinds that have not yet been officially brought into the parliament.
